Freshiz Terms of Service

Freshiz is a mobile social discovery and dating application that allows users to create connections, chat, send interactions and use the features provided by the platform.

These Terms of Service govern access to and use of Freshiz.

By using the application, users accept these Terms of Service without reservation.

Access to Freshiz is strictly reserved for people who are at least 18 years old.

By using Freshiz, each user represents that they:

• are at least 18 years old
• have legal capacity
• provide accurate information
• comply with these Terms of Service

Freshiz reserves the right to suspend or delete any account that does not comply with these conditions.

Registration is completed through Sign in with Apple.

Users agree to:

• not impersonate another person
• maintain only one personal account
• keep their information up to date
• respect other users

Users may provide profile information such as first name, age, gender, discovery preferences, biography, photos, privacy settings and location.

Users are solely responsible for the information published on their profile.

The following behaviors are prohibited:

• harassment
• threats
• identity theft or impersonation
• hateful content
• discriminatory content
• illegal content
• sharing non-consensual sexual content
• spam
• scams
• fraud
• distribution of malicious software

Freshiz may suspend or ban any user who violates these rules.

Heartbeats are one of the interaction features offered by Freshiz.

Freshiz may offer features including Discover, Likes, Matches, Messaging, Pokes, Heartbeats, connection reactivation, Ghost Mode, Influencer Mode, Horizon Mode, Premium features and in-app purchases.

These features may evolve at any time.

Pokes are one of the interactions available in Freshiz.

Like other interaction features, Pokes may evolve at any time according to the needs of the service and the platform.

Freshiz may offer a Premium subscription that provides access to certain advanced features.

Premium features may include:

• unlimited likes
• visibility of received heartbeats
• rewind on swipes
• Horizon Mode
• future features

The exact content of the Premium subscription may evolve.

In-app purchases are managed by Apple through the App Store. Freshiz never has access to users' banking information. Purchases are subject to Apple's terms of use.

Refund requests must be addressed directly to Apple. Freshiz does not directly process refunds for in-app purchases.

Freshiz may grant Influencer status to certain users.

This status is granted exclusively by Freshiz through an invitation system.

Freshiz reserves the right to:

• reject an application
• remove the status
• suspend access to the influencer program

Influencer status does not create any employment contract, commercial partnership or agency relationship.

All elements that make up Freshiz are protected by intellectual property laws.

Any unauthorized reproduction or use is prohibited.

Users remain responsible for the information, photos and content they publish on their profile.

Users may report a profile or behavior from Discover or from an existing match.

Users may block another profile to stop future interactions.

Freshiz uses moderation tools that may include:

• review of reports
• temporary suspension
• permanent ban
• restriction of access to certain features
• blocking and hashed identity enforcement

Moderation decisions are made at Freshiz's discretion.

Freshiz may suspend or ban any user who violates the platform rules.

Freshiz also reserves the right to suspend or delete any account that does not comply with the eligibility conditions.

Users may delete their account directly from the application.

Account deletion results in:

• profile deactivation
• loss of account access
• the inability to recover certain data

Certain information may be retained when necessary for legal obligations, platform security or fraud prevention.

Freshiz makes reasonable efforts to ensure service availability. However, Freshiz does not guarantee the absence of interruptions, the absence of errors or permanent availability.

Freshiz acts solely as an intermediary platform between users.

Freshiz does not guarantee:

• the authenticity of profiles
• the accuracy of published information
• the success of a meeting
• compatibility between users

Each user remains responsible for their interactions.

These Terms of Service are governed by French law.

Any dispute falls under the jurisdiction of the competent French courts.

Freshiz may amend these Terms of Service at any time. Continued use of the service constitutes acceptance of the version then in force.
